The Donald J Trump statement on his Truth Social platform that forms the basis for a war crime.
“A whole civilization will die tonight, never to be brought back again. I don’t want that to happen, but it probably will,” Mr. Trump wrote on social media, adding, “We will find out tonight, one of the most important moments in the long and complex history of the World.”
The latest discussions among national war analysts are that the only way to massively eliminate a society of 90 million people from 8 pm to 12 midnight is through nuclear means. The 8 to 12 midnight time frame is the time frame Trump used.
Google AI tells us what the "whole civilization will die tonight" goal statement would require the following:
Scale of Destruction: A single 100-kiloton weapon (smaller than many modern warheads) dropped on a dense urban center like New York City could cause roughly 583,160 immediate fatalities. At this rate, approximately 150 such weapons could theoretically reach 90 million fatalities if targeted perfectly at the most densely populated areas.
Given the size of Iran, Google AI estimates it would take hundreds of nuclear weapons to kill the Iranian society.
Wider Impact: Because much of Iran's population is rural or spread across smaller towns, achieving "total" population elimination would require a significantly higher number—likely hundreds of weapons—to cover the vast geographical area.
As you will read below, the Geneva Protocol includes the act or the threat as a breach. Trump's statement was a threat.
The Supreme Court says that Trump has Presidential immunity from all illegal acts, crimes and all. That Supreme Court immunity does not immunize him from breaches of the Geneva Protocols.
The United States Congresss can pass resolutions to refer the case against Donald J. Trump, and other culpable administration actors for war crimes to the International Criminal Court for investigation on January 1, 2027 as a single body, i.e., the Congress or the Senate or a joint resulution passed by both houses.
The provision of the Geneva Convention that was breached by the statement:
Article 51 - Protection of the civilian population
2. The civilian population as such, as well as individual civilians, shall not be the object of attack. Acts or threats of violence the primary purpose of which is to spread terror among the civilian population are prohibited.

Vladimir Putin has been indicted by the International Criminal Court for war crimes allegations committed in the Russian war against Ukraine.
On March 17, 2023, the International Criminal Court (ICC) issued arrest warrants for Russian President Vladimir Putin and Maria Lvova-Belova, the Russian Commissioner for Children's Rights, for alleged war crimes in Ukraine.
Benjamin Netanyahu has also been indicted by the International Criminal Court for crimes against humanity against the people of Gaza.

The United States, Russia and Israel are not signatories to the International Criminal Court. As you can see by Putin and Netanyahu’s indictments, not being a signatory of the ICC does not protect the perpetrator of war crimes and crimes against humanity against being investigated, indicted, tried and sentenced by the ICC.
