The TRO blocks all USPS action on the implementation of the Mail-In Ballot rule for 14 days, at which point the court will hear argument from the parties as to following up with a temporary restraining order that will continue the block the USPS Mail-In Ballot rule until the end of trial.
The key arguments against the Mail-In Ballot Rule involves authority. The Constitution vests authority in the states as to Times, Places and Manner of voting, with Congressional authority granted as Congress may determne. The Constitution grants no authority to the Executive branch, President and the USPS, as to Times, Places and Manner of having elections.
Article 1, Section 4:
The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof; but the Congress may at any time by Law make or alter such Regulations, except as to the Places of chusing Senators.
