Dear National President, Members of the National Executive Board, and Legal Counsel,
I am writing to you today out of deep respect for our organization and a shared commitment to protecting the integrity and public trust that LULAC has built over generations. A matter regarding the Texas State LULAC 2024 IRS Form 990 filing, which was submitted in November 2025, warrants our collective review to ensure we remain fully compliant with federal standards.
In reviewing the filing, Section VI, Line 11a indicates that a complete copy of the Form 990 was provided to all members of the state governing body before it was submitted. However, it is my understanding that state board members did not receive the document prior to its submission.
As we all know, the IRS Form 990 is a vital federal disclosure report. Section VI, Line 11a serves as a key governance benchmark to ensure that those with fiduciary responsibilities have full visibility into our financial disclosures before they become public record. If a breakdown in internal processes led to this box being checked mistakenly without the document being distributed, it could inadvertently expose the organization to compliance scrutiny, potential IRS audits, or unnecessary reputational risks.
To safeguard LULAC’s standing and ensure our administrative processes match our high organizational standards, I respectfully request that national leadership and legal counsel review this filing to ensure our entities remain fully protected. Taking a proactive, collaborative approach to correct any oversight will protect both the state and national entities. To that end, I recommend we consider the following constructive steps:
- Facilitate Internal Disclosure: Kindly request that the Texas State leadership distribute the complete 2024 Form 990 to all current state board members for their awareness and review.
- Review and Amend if Necessary: If it is confirmed that the document was not provided beforehand, work with the state administration to file an amended return with the IRS to accurately reflect the process and keep our filings beyond reproach.
- Support Administrative Compliance: Offer guidance to ensure that standard board routing and transparency protocols are seamlessly integrated into all future federal and state reporting cycles.
