Proyecto de ley busca otorgar plazos a negocios para corregir infracciones

Dora Herrera, propietaria del restaurante Yuca’s, se queja de haber sido demandada sin tener tiempo de hacer las mejoras.

En California, propietarios de pequeñas empresas están dando la voz de alarma ante lo que consideran demandas abusivas dirigidas a infracciones técnicas, que está llevando a muchos de ellos a tener que cerrar sus negocios. 


“Necesitamos los pequeños negocios tener esa segunda fase que nos va a dar la capacidad de arreglar todo, ayudar a los deshabilitados y no dar dinero a los abogados que son civiles”, declaró Dora Herrera, propietaria, del restaurante Yuca’s. 


Los pequeños negocios de California piden a las autoridades estatales que aprueben el proyecto de ley SB84, que busca dar más tiempo a los propietarios para corregir infracciones técnicas antes de enfrentar una demanda.


“Yo en total tuve que pagar 12 mil dólares por una demanda que decía que estábamos afectando negativamente a las personas discapacitadas. Por la mesa que estaba muy chica, porque algo que no estaba suficientemente ancho, el mostrador que está muy difícil para que ellos agarren”, agregó Dora.


Estas demandas se producen bajo la Ley federal de Estadounidenses con Discapacidades, que prohíbe la discriminación contra personas que sufren algún tipo de discapacidad. 



“Una de cada tres demandas en los Estados Unidos son aquí en California. Sabes que en muchos casos ni tienen que entrar a tu negocio. La demanda viene por el correo y te dicen, hey, tienes una multa de 5,000 dólares. No me importa si lo arreglas o no, es tu culpa y me tienes que dar el dinero. Y nunca arreglan el problema físico que dan para entrar al negocio, no te dan ni siquiera un plazo de tienes una semana para arreglarlo, simplemente te multan y ya”, comentó Víctor Gómez, director de la organización Ciudadanos de California contra el Abuso de Demandas.


En estados como Texas o Florida dan a los negocios entre 90 y 120 días para corregir las infracciones antes de enfrentar una demanda.


Sin embargo, estados como California no exigen aviso previo obligatorio y ahora los pequeños empresarios buscan una solución. 


Este proyecto de ley recibió el apoyo bipartidista y fue aprobado el pasado año por el Senado, pero por el momento se encuentra en la Asamblea de California a la espera de avanzar para llegar a votación.
