Rudy Acuna - [LRL] Clearing THE DECK

Mu principal concerns revolve around stonewalling and blatant bribery surrounding my case. Universities boast about their governance protections of faculty. However. They are like a water, spicket they can by turned on and off at the will of the institution. If you want to bring a suit there are three pockets you must check: 1) legislative laws, 2) institutional law and 3) the common law. Enforcement is up to the discretion of the administration that has considerable leeway, and unions and elected officials who are often in collusion. It is very complicated and in collusion with elected office holders influence outcomes. My case boils down to an assault on my personal property. The institution is legally bound to protect it. One of the problems is that penalties are confusing. There is no clear responsibility for the individual. My contention is that the individual faculty members are complicit. They should bs monetarily held accountable since they and others are profiting. This has led to a situation where guilty faculty and administrators profit from malfeasance. They are shielded by gimmicks such as stonewalling and the foggy line of authority. For example, in my case a series of illnesses prevented my meeting deadlines for filing grievances. Because of the laziness of chairs, the head secretary has acquired power over faculty. I could get bogged but this is precisely what the administration wants. It is part of neoliberalism.

It is difficult to discuss neoliberalism; it is made worse by the big fog, and the convulsions capitalist. The system has been made purposely involved. We read the news daily. We went to the movies on Saturday and we knew that the good guys would win. One of my favorite movies was ‘It is I a Wonderful life. “ Loved Hollywood movies the good guy and girls always won. I aill  Coo Cook’s classes. into this and the common law that estopped anyone from profiting from their malfeasance. Sat through most of Loyola Law Professor Cook’s classes. Loved the Estopel where you were stopped from profiting from your malfeasance. I want to think about this more. I want to go yo Mexico to learn more about the caste system and neoliberalism. Possible go to Chile see how they messed up that country. I want to forget about Trump.

Re: My Grievance Against CSUN

To Whom It May concern:

As a historian, I have learned that the only way that you can correct an institution of society is to base your history on the truth. In my quest to document my own grievances I learned a lot about the institution and my own situation.  I will briefly review how I was harmed.  I have spent more than fifty years at California State Northridge and its predecessor San Fernando State College. I was brought in to set up a course of study and administration of the new ethnic studies departments. I accomplished this with no support from the administration which was just as well. I was offered treats if I would do it their way. I had been an activist for a long time and refused. The administration then tried to infiltrate us and destabilize us by befriending and buying off faculty members and students. We have accumulated considerable material but many of my allegations are still based on circumstantial evidence. This brings me to my first personal grievance:

A.

1-      I requested all my records. However, I learned that although President James Cleary has been dead for over 25 years, his papers have still not been processed, which is excessive. Since half my career was served under James Cleary and important events occurred during his presidency these papers are essential. Included is correspondence in The University Corporation, the Chancellor’s Office, and elected officials. I am especially appalled by the framing of BSU Students. TUC is of special interest because it is the cause of skyrocketing tuition, costs, and layoffs of faculty and blue collar workers. It is not healthy when a university auxiliary has nearly three billion dollars in assets

2-      I have other questions to raise once I review the missing Cleary Papers. Not taking anything from the heroic role of the BSU students on November 4, 1968, more attention must be paid to the role of white professors and students played in making SFVSC receptive to the admission of minority and low achieving students.  

My grievances with Cleary will include Police surveillance and the buying off of faculty by CSUN administrators. Concealing evidence e.g., Cleary Papers, the taking away of the right to my email account, and the destruction of my research under the pretext of security (the Cisco Dear). Security is one thing censorship is another as is theft. I demand that my files are protected, and I will be made whole.

3. These hits are at the core of my grievances. What is a member of a community, academic or otherwise? What are his or her rights?   Once one reaches a vulnerable age or is incapacitated does it become open season for predators? We can talk about equity and its variable meanings, what is often left out is common decency and what is moral? When I taught in a Yeshiva, a Talmud Scholar told me that a society is judged by how we treat our young and our elderly. I see my treatment as a lack of communitarian duty. I am a respected scholar who has contributed to CSUN (see Rudyacuna.net). In this, I want the legacies of Mecha, selected faculty and OCT preserved. Therefore, I want my email account to be made whole and my documents preserved. For this, I would request outside auditors. This morning my access to Word was further restricted.

4. Impaction has negatively impacted the East Valley, Antelope Valley, and Ventura County, all with large working-class families. Impaction like segregation and the limiting of social rights has affected and is affecting worker families. So I want the The University Foundation Office and other units to desist in trying to take what is held in trust for needy students. I also request that those trying to steal these funds be charged with felonies.

5. Now for more recent violations that we have documents for.

B.  I have sent many materials to Morris[ARF1]  Barrett and the Office of Equity. I have not received his responses and in fact, CSUN continues to stonewall me. About two weeks ago I requested a log with when Mr. Morris received and when action was taken the action taken. I have also told him that the Harrison administration interfered in favor of his selection illegally eliminating a strong Latino candidate. I and others are concerned since the governance rights of the department had been violated, we almost unanimously voted for the other candidate. I would like this to be discussed in private. My purpose is to bring about corrections I do not want to break student education.

C.  The transition from Cleary to the present era is very important. Increasing AVP Don Cameron had been interfering with my professional and personal life. We need the Cleary papers to document these violations. Cameron by innuendo threatened me and my family and messed up my medical accounts. I will straighten this out when I examine the Cleary Papers. The Cameron Papers should be certified. There is evidence that Cleary himself was not satisfied with Cameron who prided himself in being a Highlander. He got his position because he would line up golf tournament dates for other over Septemberber 20, 2021

1. A further interest in Cameron is that he handled Blenda Wilson’s dirty work to clean out or control dissidents such as myself, Rodolfo Acuna.  

2. I first collided with President Wilson is when Mecha Students confronted her. She accused me of not doing my duty and defusing the students. I told her that was not in my job description and that the students were right. She through a fit. At that time, we had FMI evaluations that were based on production: books, articles, invited presents, etc. I was outstanding in each area. A candidate that had no scholarly achievements received 10 steps because he was Wilson’s bagman. He received 10 steps, I only received 2. Wilson bragged to her provost that I deserved 10 steps but would never get more than 2. I submitted a formal response to which I never got the courtesy of an answer. Cameron told me to count mu=y blessings, The next year was a repetition and again the same thing. By my accounting, I am entitled to at least 14 steps. I reported it to the union.

Under Wilson’s administration, there was a strengthening alliance between her and the campus police and the Devonshire LAPD. During the protests over the ZBT’s singing of the Lupe Song that the brothers sang as they reveled in the rape of a 4-year-old dead Mexican child. The faculty senate, the CHS Dept, and Mecha protested. The faculty senate censured the ZBT. David Horowitz defended the ZBT, and Wilson ended up secretly paying Horowitz the defense expenses. Horowitz included me in his list of 100 most dangerous professors. There is evidence of further Cameron’s “mischief.”

This was paralleled by the establishment of the Central American Studies Dept. that was brokered by Mecha which and Central American Studies. The Provost Louanne Kennedy was more emphatic. There were problems when the Spanish Dept insisted that it wanted Siglo De Oro scholars, they already had 4. Mecha lobbied us and we gave CAS three lines (positions). As usual, Louanne had her scheme in which ChS paid for the positions and she did what she wanted and Chs ended up paying for 2 positions and the administration for one. I called this to the attention of Mary Pardo who did nothing. Instead, they let the rumor or play out that Beatrice from Spanish had been transferred into ChS which Marta Lopez fanned. When I called her about it, she merely said that it was a whopper.   After this Dean Beth Say played CAS against ChS and even moved the professor into ChS at will. (What struck me was that when I began at SFVSC I had a run with Delmar Oviatt. He had just sent I believe 18 BSU students to jail and he was now stepping down as president taking the directorship of Triple T, a highly funded program to train minority students at a salary over $100,000. He knew nothing about minority students. What offended me more was that the leadership of Black Studies said nothing, I carried this rancor into a meeting, and Oviatt and I clashed, he had a heart attack, and I was blamed. To get background on the assault on the governance of the Chicana/o Studies during this period read Acuña, Assault on Mexican American Collective Memory, 2010–2015: Swimming with Sharks. Cleary may have had faults, but he respected governance and the role of the faculty senate.

The university can run smoothly if sections 600 and 700 are followed. Most of the violations against me are derived from violations of these sections. For example, a secretary is never supposed to interfere with that the function of a class that is the chair ‘s job. Chairs get three-quarters of their time off and receive a stipend that is also applied toward retirement. To keep the record straight I never shouted at a secretary or tried to discipline them that was the invention of the chair who tried to frame me and cover his track. I did say no. When Griselda told me to teach in a class with 35 seats, I still took 50 and had them sitting on the floor. She assigned my classroom to a teacher with 30 students; it could accommodate 45 and over. It did not make sense it would force a dozen students to drop and take the class the following semester. When she said that it was against the fire Marshall’s orders I told her to call the fire marshall. She also tried to force me to have the For Foundation join the CSUN Foundation run by a racist and anti-immigrant administrator, I said “no”! I did not work for the INS. I never shouted at her; she did not have the authority so why listen to her. Every trustee on the scholarship committee knew this was happening and they were willing to go along with these measures it was on their conscience but let me be clear, take ownership. Thru this, I was astonished that no one spoke up.

My grievance is that the administration was eroding our governance rights.  In the case of Carlos Hernandez, there was a unanimous vote to hire him. However, in committee, the dean offered a two-for-one deal: two Chicana historians in lieu of Carlos. There was no search nor interviews. Carlos was out and the two-candidate handpicked by Dean Beth Say, may her soul rest in hell. The picks were brought in to specifically undermine me. The incident eroded the respect that I had for Carlos who lurked in the halls complaining about the process. If you are screwed it is up to you to fight and not cringe in the shadows. I site this as background to the offenses. It also showed involvement higher up, probably by TUC in financing cooperative deans. I have always been of the opinion that you fight for your students, you fight for your program.

Lastly cite the memo of expectations. It was supposed to be like a letter of reprimand. It has holes all over it beginning with procedural violations. The Letter was not supposed to be integrated and in chronological order. It was not delivered to me and I was not allowed to respond to the letter in the presence of my CFA representative. The fact of the matter in my over 50years at CSUN I have never been cited. Even during this round, I have yet to be cited because to do so would open up a case and obligate the CFA to represent me. It is designed to keep me detoured from the case and me tying me up. However, I am coming out of my PARKINSON’S. How can the union for example say that I am no longer an employee and entitled to representation? Why not? I tried in August two years ago to bring a complaint. This is where the estoppel kicks in. Was I not an employee two years ago? Was I not an employee 6 months ago when I made six phone appointments with Antonio Gallo and he broke each one of them> Estoppel.

Moreover, aside from equity, there is the moral side of equity.  Is it moral that when a person reaches 65 everyone tries to get their social security number?  The truth be told no one would have tried this scam 10 years ago.  Now I  have possibly four articles that have been plagiarized. This is more difficult for me to digest than the loss of friends. How could they be so mediocre? I am also requesting support in the restructuring of the foundation my wife and I set up to give scholarships to students. This need will be more pressing in the years to come. The[ARF2]  money did not come from the West Valley

All that is wanted is the administration to respect my rights and those of other faculty. That is common decency. Respecting that faculty's rights are what is morally expected from the community. As for legislative laws, they are generally written by those in power. My appeal is to the common law. As mentioned even before and during my dealings with Parkinson's I appealed to the administration and the union for support, I was ignored. At the beginning of this process, I was stonewalled and stonewalled and now they tell me that I have no rights because I am no longer an employee. That is bogus. They prevent me from filing and now they want to profit from my failure to file on time?
